Official Rules and Conditions of Entry

Grand Prize:  $1,000,000.00  

By purchasing a 2024 Raffle ticket, you agree to be bound by these rules and terms.  Forward Sails LLC (1911 SW Campus Dr PMB 622 Federal Way WA 98023) is conducting this 2024 Raffle.  Tickets will be sold for $500.00 each. A maximum of 5,000 tickets will be sold.  Odds of winning are based on the number of 2024 Raffle tickets purchased.  Entrants can only win 1 prize.  

Once all 5000 tickets are sold, a random drawing will be conducted to select the winner of the $1,000,000 prize. The drawing will be conducted in a fair and transparent manner posted live online and on the website.  Must be 18 years of age or older to purchase a 2024 Raffle ticket or claim a 2024 Raffle prize. The winner cannot assign the prize to another person for any reason. You need not be present at the drawing to win. Board members of Forward Sails LLC and their immediate family members are ineligible to enter the 2024 Raffle.  The winners will be determined by a random drawing of purchased tickets.  Winners will have fourteen (14) days from the notification of winning to claim their prize.  Winners will be notified via the contact information supplied during the ticket purchase.  If the winner fails to claim their prize within fourteen (14) days, for whatever reason, the winner will forfeit the prize and an alternate winner can be selected.  If a prize is forfeited, no compensation will be given.

Prizes: The grand prize winner of the 2024 Raffle can select one of the following three prizes:  (1) $1,000,000.00. 

Winners are solely responsible for all taxes, title, and license fees if applicable for any prize won. Forward Sails LLC reserves the right to determine eligibility of an entrant. Entrants deemed ineligible will forfeit winnings.  Forward Sails LLC makes no warranties with regard to the prize.  Prize is not transferable.  Forward Sails LLC reserves the right to substitute a prize of equal or greater value.  Forward Sails LLC is not responsible for damaged or lost prizes.  

Prior to receipt of the prize and no later than the end of the calendar year, winners must provide Forward Sails LLC with a properly completed and signed IRS Form W-9 form.  For prizes with a retail value of $600 or greater, at the time of the award presentation, Forward Sails LLC will present the winner with a W-2G form, and will file a copy of the form with the IRS. 

Publicity:  As a condition of being awarded a prize, winners will be required to sign an Authorization and Release for Use of Image, Voice, or Likeness (the “Release”) and must show a current / valid photo identification to claim and pick up their prize.  Forward Sails LLC reserves the right to require additional identification and may choose to accept or deny awarding any prize based on the identification presented.  If the winner fails to submit the Release, winner forfeits the prize and an alternate winner will be drawn from the remaining entries.  The Release will also allow Forward Sails LLC to share the winners’ name, voice, recording, video recording, and photo likeness for any and all marketing and publicity purposes as it may deem desirable to communicate the winners of the 2024 Raffle and future 2024 Raffles. 

Release of Claims:  BY PARTICIPATING IN THE FORWARD SAILS LLC’S  2024 RAFFLE, ON BEHALF OF YOURSELF AND MEMBERS OF YOUR HOUSEHOLD, RELATIVES, HEIRS, ASSIGNS, EXECUTORS AND ADMINISTRATORS AND PERSONS WHO USE THE PRIZE AWARDED BY FORWARD SAILS LLC, EACH ENTRANT AND WINNER RELEASES FORWARD SAILS LLC, ITS BOARD MEMBERS, AGENTS, OR REPRESENTATIVES (INDIVIDUALLY AND/OR COLLECTIVELY “FORWARD SAILS LLC”) FROM ANY AND ALL LIABILITY FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, ATTORNEY’S FEES) CAUSED BY PARTICIPATING IN THE 2024 RAFFLE, AND/OR USE OF THE PRIZE, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY AND/OR DEATH, AND EACH PARTICIPANT AGREES TO INDEMNIFY AND HOLD FORWARD SAILS LLC , JOINTLY AND SEVERALLY, HARMLESS FROM ANY AND ALL LOSSES, DAMAGES, RIGHTS, CLAIMS AND ACTIONS OF ANY KIND ARISING FROM, IN CONNECTION WITH, OR AS A RESULT OF PARTICIPATING IN THE 2024 RAFFLE OR THE WINNER’S ACCEPTANCE OR USE OF ANY PRIZE, INCLUDING WITHOUT LIMITATION, PERSONAL INJURY AND/OR DEATH. A 2024 RAFFLE ENTRANT’S SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM AGAINST FORWARD SAILS LLC ARISING OUT OF THE SALE OF TICKETS OR THE CONDUCT OF THE 2024 RAFFLE SHALL BE LIMITED TO THE RETURN OF THE PURCHASE PRICE PAID FOR THEIR TICKET(S). IN NO EVENT SHALL FORWARD SAILS LLC  BE LIABLE TO ANY PARTICIPANT OR PARTY FOR ANY LOSS OR INJURIES TO EARNINGS, PROFITS OR GOODWILL, OR FOR ANY INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES OF ANY PERSON OR ENTITY WHETHER ARISING IN CONTRACT, TORT OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

General Conditions:  Forward Sails LLC reserves the right to cancel, suspend and/or modify the Forward Sails LLC  2024 Raffle, or any part of it, if any fraud, technical failures, natural disaster, human error or any other factor beyond Forward Sails LLC’s reasonable control impairs the integrity or proper functioning of the Forward Sails LLC  2024 Raffle, as determined by Forward Sails LLC in its sole discretion. In such event, Forward Sails LLC, in its sole discretion, reserves the right to award the prize at random from among the eligible entries received up to the time of the impairment. Forward Sails LLC reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Forward Sails LLC  2024 Raffle or to be acting in violation of the Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Forward Sails LLC 2024 Raffle may be a violation of criminal and/or civil law, and should such an attempt be made, Forward Sails LLC reserves the right to seek damages from any such person as allowed by applicable law. Forward Sails LLC’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 

Compliance with the Law: All issues and questions concerning the construction, validity, interpretation and enforceability of these official rules, or the rights and obligations of you and Forward Sails LLC in connection with the Forward Sails LLC 2024 Raffle, shall be governed by, and construed in accordance with, the laws of the State of Delaware, without giving effect to any choice of law provisions.  All applicable federal, state, and local laws and regulations apply. 

Disputes:  By participating in the Forward Sails LLC  2024 Raffle, you agree to waive the right to trial by jury of any action, suit, proceeding, dispute, claim or controversy arising out of or relating to the Forward Sails LLC 2024 Raffle.  In the event of a dispute arising out of this Forward Sails LLC 2024 Raffle, you and Forward Sails LLC will attempt in good faith to resolve the dispute by mediation before a mutually agreed upon mediator, or, failing mutual agreement as to a mediator and/or alternatively, appointed by and through the American Arbitration Association (“AAA”), and to share equally in the cost of mediation. If the dispute is not resolved through mediation, then arbitration will apply.  ARBITRATION MUST BE ON AN INDIVIDUAL BASIS. The arbitration shall be conducted in Delaware, by one neutral arbitrator chosen by AAA according to its Commercial Arbitration Rules.  Except where prohibited by law, by participating, you agree that any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Forward Sails LLC 2024 2024 Raffle.
